LBJ has responded to the questions from the Town Hall Meeting held on Saturday, February 23, 2013. The responses from the other Legislators will be posted as received:
Question 1
This region needs to be more proactive for commercial development along the South Fulton Parkway and Camp Creek Parkway corridors. Can we create a low-tax district for commercial development and control the developments? Not just warehouses and trucking.
Before the session began, I met with several commercial property owners regarding a CID (Commercial Improvement District) along Camp Creek parkway.  It appears that the idea is well received from the property owners.  I will work to ensure that any such district is fair to the citizens and balanced for the community.  We want tax break but not any that have a negative impact on the community. I also am supporting the growth of small business owners through the creation of the Camp Creek Merchants Association.  We have to have infrastructure to support the businesses in our community to make any CIDs effective.

How do we contact the Department of Justice in reference to HB 171, or is it time?
It is time.  Please be specific in your contact by referring to Fulton County Georgia Redistricting and Georgia HB171.  However your communication must start now and remain consistent over the next few months.

To my knowledge they will not have an effect.

It will reduce your voting power by reducing the number of commissioners that represent you.

What specific legal action will be taken if Bill passes?
This is a question that is more appropriately answered by the Commissioners who will have the option of litigation.
Question 6
If the goal is to create Milton County, what’s the motivation to financially strap Fulton County?
Although there has not any direct acknowledgement from the authors of the bills that these bills are related to Milton County, there are some legislators that  do not agree with the creation of a new county for multiple reasons.  If Fulton County appears to be financially unstable there is more argument to be made by Milton proponents to gain support of their colleagues who otherwise would not agree with Milton.  It was expressed to me that the proponents of Milton do not think it is the role of government to provide services such as arts, informational television and more.  The same reasons for not supporting those services are the same reason for requesting a new county.

If Milton County comes up for a vote, will it have to be voted on State wide? Fulton & Dekalb?
Statewide for the constitutional amendment to add another county to the state, then a separate statewide vote to create Milton County.

Who is the Independent Senator?

As a resident of district 65, there appears to be a lack of response on certain levels of our political system from elected officials regarding neighborhood crime by juveniles and the point system. Do you have any recommendations that you can share at this time?
As a member of the Judiciary committee I can tell you about a massive Juvenile Justice reform bill moving through the house. This bill makes it clear that the point system is optional and we can directly lobby our juvenile judges to handle those cases the way we deem appropriate.  The bill also changes the level of some juvenile crimes.  Although, unfortunately it does not address the crimes such as burglary that our districts tend to be concerned about..  Most importantly the bill creates funding for community based programs to address juvenile delinquents – I strongly encourage our community to pay attention as this money is handed out and help to identify 501(c)(3) programs with experience in transforming juvenile behavior in a way OUR community deems fit.

Please explain the current point system that is in place for juveniles who commit crimes in Fulton County. What is the current status?
See answer above.  Currently, when a juvenile is arrested for certain offenses, court officials complete a DAI (Detention Assessment Instrument).  The DAI looks at the type of offense, who was involved, the number of offenses previously committed and other issues and assigns a point value to each question.  Over a certain number of points determined whether the juvenile is detained.  This DAI was reevaluated as a part of the juvenile justice reform before the House this legislative session.
Question 11
What is the status of HB 22, incorporation of municipalities?
This bill was introduced to address some matters in Dekalb County, it has not moved into committee and it appears the bill’s authors will not push the bill through.  Unless someone else picks it up for their own reasons it does not appear that it will pass at this time.
Question 12
The Bill introduced to change the Tax Commissioner from an elected position to an appointed position: Is that legal/constitutional? What is the thoughts in the Legislature on such meddlesome legislation?
Any bill of this sort must be pre-cleared through the Department of Justice to determine it’s constitutionality.  (see bill here) http://www.legis.ga.gov/Legislation/20132014/130888.pdf
This bill will give the Fulton Board of Commissioners the authority to make the appointment.  I do not agree with making any previously elected office turning into an appointed office.  However, it is incumbent upon us as a community to become more active in voter registration, in identifying and supporting candidates for office, holding our elected officials responsible once they get in office, and getting out voters to the polls.
Question 13
Have they dropped the Bill to make the Fulton County Board of Education a partian (partisan) election?
Unless this bill is entitled something else I did not see it upon my research.
Question 14
What are the chances that North Fulton County will become Milton County?
I do not believe, based on the lack of support for HB 170 that there is the constitutionally required numbers of 120 votes in the House, however, deals are cut everyday and we must remain vigilant and active to prevent it from passing.
Question 15
How many times can a Bill be brought to the floor? Once a bill is voted on, a bill must restart as a new bill and go back through the process.  However, if it is not voted on it can be brought back each legislative day at the will of the Speaker of the House.
How can this happen-redistricting map change? Through the proposing of legislation and its subsequent passage.
What can be done about redistricting that was approved by the Justice Department?  Nothing.
What is Milton County?  It is a former County that was combined with Fulton years ago and is now attempting to be reformed and made up of all the Cities in Fulton north of the City of Atlanta.
How will Milton County affect us?  More than 40%  of the Fulton tax base  comes from what would be Milton County and would cause a financial decline in the County despite the fact Fulton would still be responsible for Grady, MARTA, and all the other services provided.
Do you know what the Governor thinks about the 3 bills? No.
